Welcome to Daily Tonic: Ear Training (hereinafter referred to as "the App", "we" or "the Service"). These Terms of Service constitute a legally binding agreement between you and Daily Tonic.

Important Notice: Please read these Terms of Service carefully before using the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Service Description

Daily Tonic is a music ear training app designed to help users improve their musical hearing abilities. The App provides the following services:

  • Pitch recognition training
  • Interval identification practice
  • Learning progress tracking and statistics
  • Personalized training configuration
  • Multi-language interface support

2.1 Service Versions

  • Free Version: Includes basic features with advertisements
  • Premium Version: Unlocked through in-app purchase, removes ads and provides full functionality

3. User Eligibility

The App is suitable for users of all ages. If you are under 18, please use the App under the supervision and consent of a parent or legal guardian. By using the App, you represent that:

  • You are at least 13 years old, or using with parental/guardian consent
  • You have the authority to agree to and comply with these Terms of Service
  • All information you provide is true, accurate, and complete

4. License Grant

4.1 License Granted

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download, install, and use the App on iOS devices you own or control
  • Use the Service as designed and intended
  • Enjoy premium features you have purchased (if applicable)

4.2 Usage Restrictions

Unless expressly permitted by law, you may not:

  • Copy, modify, adapt, translate, or create derivative works from the App
  • Decompile, reverse engineer, or disassemble the App
  • Remove, circumvent, or modify any technical protection measures
  • Rent, lease, sell, sublicense, distribute, or transfer the App
  • Use the App for any commercial purpose
  • Use automated tools or bots to access the App

5. In-App Purchases

5.1 Purchase Information

  • All purchases are processed through Apple App Store
  • Prices are displayed in local currency and may vary by region
  • Purchases take effect immediately upon completion
  • Premium version is a one-time purchase, valid permanently

5.2 Refund Policy

In-app purchases are processed by Apple, and the refund policy follows Apple App Store regulations. To request a refund, please contact Apple Support or submit a refund request through the App Store app.

Apple Refund Policy: Generally, refunds can be requested within 14 days of purchase. For details, please refer to Apple's Refund Policy.

6. Intellectual Property

The App and all its content, features, and functionality (including but not limited to information, software, text, audio, graphics, logos, interface design, etc.) are owned by Daily Tonic or its licensors and are protected by international copyright, trademark, patent, and other intellectual property laws.

  • Audio samples: Using open-source sound libraries (MuseScore General, TimGM6mb)
  • User-generated content: You retain ownership of your training data

7. User Content and Data

7.1 Your Data

You own the training data, learning records, and other content you generate while using the App. We will protect your data security according to our Privacy Policy.

7.2 Data Backup

Your training data is primarily stored locally on your device. We recommend regularly backing up your device data. We are not responsible for data loss due to device loss, damage, or app deletion.

8. Disclaimer

Important Disclaimer:

  • "As Is" Basis: The App is provided on an "as is" and "as available" basis, without any express or implied warranties
  • No Performance Guarantee: We do not guarantee the App will be error-free, uninterrupted, or meet your specific requirements
  • Educational Purpose: The App is for music training and educational purposes only, with no guarantee of specific learning outcomes
  • Health Notice: Prolonged use of electronic devices may affect vision and hearing; please use moderately and take breaks as needed
  • Volume Warning: Please adjust volume to a comfortable level before use to avoid hearing damage

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any direct, indirect, incidental, special, or consequential damages arising from use of the App
  • Our total liability shall not exceed the amount you paid for the App in the past 12 months
  • We are not responsible for the actions or content of third-party services (such as ads, Apple services)
  • We are not liable for service interruptions due to force majeure (such as network outages, device failures)

10. Service Changes and Termination

10.1 Service Changes

We reserve the right to modify, suspend, or terminate any part or all of the App's functionality at any time without prior notice. We will make reasonable efforts to notify users of significant changes.

10.2 Account Termination

We may terminate or restrict your access to the App under the following circumstances:

  • You violate these Terms of Service
  • Your actions may harm us or other users
  • Required by law or government order

These Terms of Service are governed by and construed in accordance with the laws of your country/region, without regard to conflict of law principles.

15. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, that provision shall be modified or removed to the extent necessary, but this shall not affect the validity and enforceability of the remaining provisions.

16. Entire Agreement

These Terms of Service and the Privacy Policy constitute the entire agreement between you and Daily Tonic regarding use of the App, superseding all prior oral or written agreements.
